Can I afford your services – What are your fees?
All initial consultations regarding your case are free. Once retained to represent you, we work on a contingent fee basis meaning that our fee is contingent upon prevailing on your behalf.
Who pays for case costs?
Once we decide to accept a case, we advance all case costs. Case costs include, but are not limited to, expenses such as investigation, filing fees, medical records, expert witness fees, etc. While we are happy to advance case costs on our clients’ behalf, Oregon State Bar regulations state that clients are responsible for case costs regardless of the outcome. Case costs which we advance on behalf of our client are generally recouped and recovered from our client’s recovery upon the successful completion of the case.
Will I have to go to court?
Statistically, the vast majority of all injury and accident cases settle prior to trial. At Tichenor Dziuba Law Office we prepare every case as if it is going to be tried. We find that this approach yields the best results for our clients because it signals to the insurance companies that our clients are committed to full, fair and just compensation.
Will you take my case?
We only accept those cases which we believe have merit. We try to advise potential clients as quickly as possible as to whether we will be able to accept their case. Sometimes, the decision cannot be made as to whether a case has merit until reasonable investigation has been completed.
How long will this process take?
The answer depends on the case. Once filed in court, most cases in Oregon are resolved within 14 months, unless there is an appeal or other delay. Luckily, Multnomah County, Oregon has one of the fastest dockets in the country.
